The United States District Court for the Northern District of California has preliminarily approved three class action settlements, known as the “First Round Settlements,” between Plaintiffs Brand Little, Robin Burns, and Cherry Fisheries Inc. (“Cherry Fisheries”) on behalf of commercial Dungeness crab fishers against defendants collectively known as Pacific Seafood Procurement, LLC in this Litigation. The Settlement class has been provisionally certified in this antitrust class action lawsuit, entitled Little, et al. v. Pacific Seafood Procurement, LLC, et al., Case No. 23-cv-01098. United States Magistrate Judge Alex G. Tse is presiding over this class action (the “Action”). The United States District Court for the Northern District of California (the “Court”) authorized the issuance of the Notice and this website.
The lawsuit claims that commercial Dungeness crab fishers operating in California, Oregon, and Washington (excluding Puget Sound) were injured financially by the alleged conspiracy of the named Defendants to fix, stabilize, and/or suppress the ex-vessel price for Dungeness crab, and that Defendants are responsible for those injuries.
The First Round Settlement between the Plaintiffs and Pacific Seafood Procurement, LLC was preliminarily approved by the Court on August 24, 2026. The Defendants settling in this round, Pacific Dream Seafoods, Inc.; Caito, Inc.; and Fisherman’s Choice, LLC, have agreed to pay certain amounts into a common Qualified Settlement Fund or provide Plaintiffs cooperation in pursuit of litigation against the remaining non-settling Defendants in the Action. In exchange for this Settlement Consideration, First Round Settlement Class Members will be required to completely release the Settling Buyers and related parties (collectively “Released Parties”) from liability for any financial injuries that they have suffered or may suffer as a result of the conspiracy. This release will not affect First Round Settlement Class Members’ claims against the other Defendants, which will continue to be pursued.
The Court has not yet decided whether approve to the First Round Settlements and will hold a Final Fairness Hearing to consider whether the First Round Settlements are fair, reasonable and adequate.
